Equal Pay Act Lawyer

Elizabeth Cady Stanton once wrote, “We hold these truths to be self-evident: that all men and women are created equal.” Equality demands equal treatment. So imagine discovering that a male coworker in the same role, with similar experience, earns significantly more than you. You work just as hard—maybe harder. Yet, your paycheck doesn’t reflect your value. The Equal Pay Act (EPA) exists to prevent wage discrimination, but many employers still violate it. That’s where an equal pay attorney comes in.

At King & Siegel LLP, we focus on fighting for employees whose employers have shortchanged their pay. Our legal team has secured tens of millions for employees in just five years, highlighting our track record in wage discrimination cases. With our aggressive legal strategies, we will fight to ensure you receive every dollar from your employer.

If you believe your employer is underpaying you, we can discuss your options in a free 30-minute consultation. Reach out today, and let’s take the first step toward securing the compensation you rightfully deserve.

What Is the Equal Pay Act and How Does It Protect You?

The Equal Pay Act of 1963 (EPA) is a federal law requiring employers to pay men and women equally for substantially similar work. Under the EPA, employers must provide equal pay for equal work, regardless of gender. The law applies to all forms of compensation, including salary, bonuses, stock options, and benefits. Employers may only justify pay differences based on legitimate factors such as seniority, merit, or a system that measures earnings by quantity or production quality.

However, the fight for fair wages doesn’t stop there. In Texas, additional state and federal laws protect employees from gender-based pay discrimination. These include:

  • Title VII of the Civil Rights Act of 1964prohibits pay discrimination based on race, gender, religion, or national origin;
  • Texas Labor Code Chapter 21—provides additional protection against wage discrimination; and
  • Lilly Ledbetter Fair Pay Act—extends the statute of limitations, allowing employees to file claims based on repeated unequal paychecks.

Even with these laws, wage discrimination is unfortunately still prevalent. Many employers attempt to justify pay gaps with vague explanations that do not hold up under legal scrutiny. That’s why having an experienced equal pay attorney matters—they can assess whether your employer’s justification is legally sound or a cover for discrimination.

If your employer pays different wages for the same work, an experienced employment attorney at King & Siegel can help determine whether your case qualifies under state and federal laws.

What Are the Signs I Might Have a Wage Discrimination Case?

Wage discrimination is often subtle, making it difficult to recognize without careful analysis. Many employees assume that minor pay differences are justified or that raising concerns could jeopardize their jobs. However, understanding the signs of unfair pay can empower you to take action and protect your rights.

Not all pay disparities are illegal. However, if any of these apply to your situation, you may need an equal pay attorney:

  • Your employer denied you a raise or promotion others received with similar qualifications;
  • Your employer bases a pay gap on “market forces” but fails to provide objective justification;
  • There is a pattern of gender or racial wage disparities at your company;
  • Your employer retaliated after you raised concerns about unfair pay;
  • Your employer has a history of wage discrimination lawsuits or complaints against them;
  • Significant pay disparities exist within your department, even among employees with similar experience and tenure;
  • Although your job duties have increased, your pay has remained the same, while others in similar roles have received raises; or
  • You were discouraged from discussing salary with coworkers, or your employer has policies against pay transparency.

Discrimination doesn’t always come with a paper trail. That’s why having a proactive legal team matters. We dig deep to uncover evidence of unlawful wage practices.

How Can Equal Pay Lawyers Help?

Skilled equal pay lawyers do more than file a lawsuit. We provide a strategic approach tailored to your goals. Here’s how we help:

  • Eagle-eyed case evaluation. We scrutinize your case to assess whether your employer has violated the Equal Pay Act or other wage laws.
  • Meticulous evidence gathering. We compile company records, wage data, and witness statements to build a compelling case.
  • Skilled negotiation and litigation. We negotiate aggressively for a fair outcome, but if your employer doesn’t offer just compensation, we’ll take them to court.
  • Aggressive retaliation protection. If your employer retaliates, we can pursue additional legal claims.

You don’t have to navigate this fight alone. Let us handle the legal battle while you focus on your future.

What Can an Equal Pay Attorney Help Me Recover in an Equal Pay Lawsuit?

When you take legal action, you’re not just standing up for yourself but holding your employer accountable. If successful, you could recover:

  • Back pay. These are the wages you should have received, sometimes doubled under the EPA’s penalties.
  • Compensatory damages. You may receive reimbursement for emotional distress and career setbacks.
  • Punitive damages. In cases of deliberate wage discrimination, courts may award additional penalties.
  • Legal fees. Employers may be required to cover your attorney’s fees and court costs.

Our legal strategy aims to maximize your compensation and ensure your employer never underpays workers again.
